Prohibited Conduct

Title IX is designed to insure that no person is discriminated against on the basis of sex/gender in an educational setting through sexual harassment. The Policy prohibits specific forms of behavior, which the Policy collectively refers to as “Prohibited Conduct.”

To be a Title IX Violation the conduct must fall under the following categories:

  • Sexual Harassment
  • Stalking on the basis of sex
  • Sexual Assault
  • Dating/Domestic Violence

And must be under the following conditions:

  • In any education program or activity of the recipient against a person in the United States.
  • A covered program or activity includes locations, events, or circumstances over which the University:
    • Exercises substantial control over the respondent and
    • the context in which the sexual harassment occurs

Some prohibited conduct does not rise to the level of sexual harassment as defined by Title IX, but is still considered unwelcome sexual conduct at MVNU. This conduct may may have continuing adverse effects on campus, on any member of the University community, or in the context of any University education or employment activities and programs, regardless of where the conduct occurred, and will also fall under our policy:

  • Sex/Gender Discrimination
  • Non-Consensual Sexual Contact
  • Sexual Exploitation
  • Physical Harm and Intimidation
  • Cyber bullying
  • Retaliation
